									<p>As a new school year gets underway, some educators may unfortunately have the need to reach out for legal guidance. Below is a quick guide to how eligible members can contact the ATPE Member Legal Services Department (MLS), including what information they should be ready to provide.</p><h4>Request legal assistance via phone</h4><p>Eligible ATPE members can contact MLS by calling (800) 777-2873 and pressing option 1.</p><p>If you are calling about an ongoing matter, a legal assistant will route you to the appropriate attorney or the attorney’s voicemail. If you are contacting MLS about a new matter, the legal assistant will need a few minutes to complete the intake process before routing your call to an attorney. During this intake process, the legal assistant will verify your eligibility for member legal assistance and collect basic facts about your inquiry.</p><p>MLS phones are answered from 8 a.m. to noon and 1:15 p.m. to 5 p.m.</p><h4>Request legal assistance online</h4><p>Members who cannot call ATPE during the day or who prefer to submit their questions online can use the <a href="https://member.atpe.org/Member-Legal-Services" data-feathr-click-track="true" data-feathr-link-aids="5df34522dc3cdfabf6401f28">Member Legal Services Intake System (MLSIS)</a>.</p><p>When submitting a question, please provide key details, relevant dates, and the names of the people who are involved. You may also upload documents that are important to the matter. Providing complete information at the outset can help MLS better understand the issue and may avoid delays caused by having to request additional information.</p><p>We generally respond to MLSIS submissions within one to two business days, though response times may vary. When possible, members with urgent issues or short deadlines should contact MLS by phone.</p><h4>Other methods of requesting legal assistance</h4><p>Members occasionally contact other ATPE departments or staff members with workplace or legal concerns. Those communications can be forwarded to MLS, but doing so adds an additional step before the legal intake process can begin.</p><p>For the most direct route, contact ATPE MLS by phone or through MLSIS.</p><h4>Understanding ATPE’s intake process</h4><p>Educators are busy and often have limited time during the workday, so we try to make the intake process as quick and straightforward as possible. That’s why we appreciate your patience as we verify your current employment and contact information and gather the basic facts needed to evaluate a member’s concern, including relevant dates, the people or entities involved, and the action or conduct at issue. This information helps ATPE determine the best way to assist you. For instance, if another ATPE member is involved in your eligible job-related concern, you may be referred to an outside attorney from our approved network to avoid a potential conflict.</p><h4>Be assured of confidentiality when contacting ATPE Member Legal Services</h4><p>Information provided to MLS is treated as confidential. Once an attorney-client relationship is established, communications between a member and an MLS attorney generally are protected by the attorney-client privilege, subject to limited exceptions.</p><p>Except in very limited circumstances, MLS attorneys will not contact a member’s district, administration, or colleagues about the member’s matter without the member’s authorization.</p><h4>When to contact ATPE Member Legal Services</h4><p>Members may contact MLS when they have questions or concerns about an employment matter, certification issue, or other matter within the scope of MLS assistance.</p><p>Timing can be particularly important when a matter involves a deadline, a pending disciplinary action, or another action by a school district or other employer. Because some deadlines can be short, members should consider contacting MLS promptly when they become aware of an issue that may have legal or employment consequences.</p><p>Depending on the circumstances, an MLS attorney may be able to help a member understand the applicable law or policies, evaluate available options, and make informed decisions about how to proceed. In other situations, the appropriate course may be to address the issue through informal communication or another process.</p><p>MLS attorneys strive to provide members with accurate and candid legal advice. That means we will explain both the potential strengths and limitations of a member’s position so the member can make informed decisions about how to proceed.</p><h4>Eligibility for ATPE’s member legal benefits</h4><p>Eligibility for MLS assistance generally depends on when the underlying matter arose and whether the member was eligible for MLS assistance at that time.</p><p>Generally, MLS cannot assist with matters that began before the member became eligible for assistance or that arose during a lapse in eligibility. Eligibility can depend on the specific circumstances, so members with questions about whether a particular matter is covered should contact MLS for clarification.</p>								</div>

									<p>Workplace surveys are everywhere—climate surveys, culture surveys, engagement surveys, leadership feedback surveys. They’re usually introduced with reassuring language about honesty, transparency, and anonymity. Employees are encouraged to “speak freely” and “share candid feedback.”</p><p>Before you hit submit, though, it’s worth pausing to think about what “anonymous” can really mean in practice.</p><h2>Why “Anonymous” May Not Mean Untraceable</h2><p>Survey invitations often promise anonymity. In many cases, the people sending the survey genuinely intend for employees to feel safe sharing feedback. But the reality is that anonymity can be complicated.</p><p>Surveys may be distributed through internal systems, vendor platforms, or individualized links. They may track participation rates, require logins, or collect background information meant to help interpret results. Depending on how a survey is distributed or accessed, there may be technical data in the background, including login information, timestamps, participation tracking, or link usage that could make responses less anonymous than employees assume.</p><p>Most administrators are not trying to “unmask” respondents. But the reality is that modern technology often creates data trails, even when anonymity is the goal.</p><h2>Think Before You Type</h2><p>This doesn’t mean employees should avoid participating in workplace surveys. Feedback can be valuable, and many districts, campuses, and administrators genuinely want to improve conditions.</p><p>It does mean, however, that employees should approach surveys thoughtfully. Whatever the reason, needing outside income is a reality for many educators.</p><p>The good news: Many school districts understand this and generally allow outside employment. The important part is knowing where the guardrails are before accepting that extra work.</p><h2>Outside Employment Is Usually Allowed</h2><p>Most districts do not prohibit second jobs. In fact, many educators work evenings, weekends, or summers in other roles. The phrase that appears frequently in district policy is that outside employment must not interfere with your primary duties or create a conflict of interest.</p><p>That may sound simple, but those two ideas, interference and conflict, are where most problems start.</p><h2>Why Summer Work Is Typically Low-Risk</h2><p>Summer is the easiest time to take on extra work, and the risk of outside employment affecting your school job drops significantly. Summer school, summer camps, tutoring, retail work, seasonal employment, and curriculum writing are all common examples.</p><p>Even so, summer work can still create issues if it overlaps with district business or vendors. It’s rare—but not impossible—for problems to arise.</p><h2>During the School Year, the Rules Get Tighter</h2><p>Working a second job during the school year isn’t prohibited, but districts look more closely at the impact. For example, does the outside job affect attendance or punctuality, create fatigue that impacts performance, compete with district services, or involve your students?</p><p>Most policies related to outside employment focus on when the job begins to affect the educator’s primary role.</p><h2>A Major Update for Administrators</h2><p>A recent state law now places significant limits on outside employment for superintendents and certain administrators. The intent is to prevent conflicts of interest and ensure district leaders remain fully focused on their responsibilities.</p><p>Teachers are not subject to the same level of restriction, but administrators should assume outside work now requires much closer review and, in many cases, school board approval.</p><h2>Checking District Policy</h2><p>Before accepting outside employment, review your district’s local policy and your contract. Many districts require employees to disclose second jobs or seek approval, especially if the job is somehow related to education. Families will increasingly have funds available for supplemental academic support, test prep, and specialized instruction.</p><p>This can be a great opportunity, but it comes with important boundaries.</p><p>Tutoring homeschooled students or students from other schools/districts is generally lower risk. Tutoring your <em>own</em> students, however, is where districts often draw a hard line. Concerns about fairness, pressure on families, and grading conflicts mean some districts prohibit it entirely, while others require disclosure and approval.</p><p>When in doubt, ask before accepting payment.</p><h2>Keep School Resources Separate from Side Work</h2><p>A simple rule can prevent a lot of trouble: If the district paid for it or you produced it as part of your district job, you may not be authorized to use it for your side job.</p><p>That includes curriculum, materials, facilities, equipment, and work time. Even small overlaps can become policy violations.</p><h2>A Quick Word About Social Media</h2><p>Educators are public professionals. Although <em>this</em> article is written with 100% human intelligence (HI), I prompted ChatGPT to create an entirely independent AI version for comparison. <a href="#AI-Response">See below</a>.</p><p>Like many of you, I have used AI in both serious and lighthearted contexts. When used in the workplace, however, it is important to distinguish between responsible and irresponsible uses of AI, especially in high-stakes contexts. AI can help teachers save time, reduce workload, manage administrative tasks, and learn more about unfamiliar concepts. But like any tool, it is important to use AI with caution and oversight and ensure it is the appropriate tool for the job.</p><p>The ATPE Member Legal Services Department has noticed an increase in members sending AI-produced documentation. The telltale signs can make it obvious: bold terms, phantom references, and heavy usage of bullet points. In some contexts, such as when a teacher sends a reprimand response or complaint summary for an attorney to review, that may be perfectly acceptable. An experienced attorney can review the document for accuracy and revise it based on their personal knowledge and professional experience.</p><h2>Common Pitfalls for AI Use by Educators</h2><p>That said, using AI carries risks. Users should not upload any confidential information. When I use AI for legal research, I limit my searches to general questions and never identify school districts or individuals by name. Similarly, teachers should refrain from entering any personally identifiable student information. Strict confidentiality applies to academic, attendance, disciplinary, and medical information relating to a specific student, including Individualized Education Program (IEP) and Behavior Intervention Plan (BIP) requirements. If a teacher asks whether an incident with their principal constitutes illegal harassment, AI may default to supporting the teacher’s perspective, even if the facts don’t truly support that conclusion. I have verified this tendency by testing various responses to hypothetical employee questions.</p><p>Another concern is AI hallucination. Hallucinations are realistic sounding but false statements presented confidently as factual. I have experienced this myself on several occasions, receiving AI responses citing outdated laws, proposed legislation that was never enacted, and sometimes laws that do not exist.</p><p>AI sycophancy and hallucinations can work in tandem to provide persuasive but inaccurate results. For example, while researching whether Texas has legally mandated minimum and maximum classroom temperature guidelines, ChatGPT initially provided a confident answer, even citing what appeared to be a legitimate code section. Upon further research, I discovered ChatGPT was citing a handbook for the Hanover County Public Schools in Virginia. Oops!</p><h2>Smart Strategies for Safer AI Use by Educators</h2><p>The good news is that there are practical ways to minimize these risks. As with any search query, well-crafted prompts (how you ask the question) matter. It’s natural to describe events or ask questions from your own perspective. However, because AI tends to provide supportive responses, you will typically get more accurate results by presenting neutral facts and posing objective questions.</p><p>It is also helpful to ask follow-up questions, especially if the first response seems too favorable. When submitting research questions to AI in preparation for this article, I received more balanced guidance when I asked follow-up questions such as, “How would HR realistically view this type of complaint?”</p><p>Always verify results using reliable sources. On a few occasions, I have found ChatGPT to be particularly stubborn, continuing to debate (politely) even after I questioned whether it was referencing the most current version of the law. AI trained on broad web-based information has access to both accurate and outdated material. Finding the correct answer may require several follow-up questions and cross-checking the results against a trusted source.</p><p>Another strategy is using a more targeted AI platform trained on a specific set of data. For attorneys, several legal-focused AI tools require paid subscriptions. A safer approach is to emphasize respectful dialogue, civic learning, and lawful avenues for student expression outside of instructional time.</p><p>TEA’s guidance expects teachers to “take affirmative steps to prevent” student disruptions but does not offer specifics as to how an educator is supposed to handle a classroom walkout in real time. Because teachers are expected to remain on campus, monitor all of their students, and not “neglect students released onto public streets,” what is the protocol if half of the teacher’s class suddenly gets up and walks out? This puts a teacher in an impossible situation due to conflicting expectations and the fact that a teacher should not be expected to put themselves at risk by physically blocking students from leaving.</p><p>Educators should prepare themselves by proactively requesting guidance and support from their administration on various scenarios, including responding to difficult student questions, handling walkouts during class, and determining when parent notification is required.</p><p>Ultimately, teachers do not need to suppress their personal beliefs, but they do need to protect their livelihoods and their students. 									<p>Learning that the Texas Education Agency (TEA) is taking over your school district is understandably stressful and can lead to confusion and uncertainty. If TEA intervenes, here’s what you should know—what changes are likely, what may remain the same, and how you can navigate the transition.</p><h2>Why TEA might intervene</h2><p>TEA may step in when a district is underperforming academically or financially or has serious governance issues. The most common reason is when a campus receives failing grades (an ’F’) from the state’s accountability system for at least five consecutive years. But takeovers have also resulted from allegations of financial mismanagement and test score inflation. </p><p>When these triggers occur, the TEA commissioner can appoint what’s called a “board of managers” to take over board governance functions. The elected board of trustees remains in office in an advisory capacity, and local elections continue. But while the board of managers is in place, the board of trustees no longer has governing authority. Once the Commissioner has determined that the district has met his conditions, the commissioner will announce the end of the appointment and transition governance back to the elected board of trustees.</p><h2>Potential changes for employees</h2><p>TEA may remove or suspend the elected school board, replacing it with a state-appointed board of managers. It may also appoint a new superintendent or require changes to existing leadership. A conservator may also be appointed to oversee a campus or district.  While not guaranteed, districts undergoing takeover often implement reorganizations that may result in reassignments, nonrenewal of probationary contracts, new performance expectations, and possibly increased turnover.</p><p>Takeover districts frequently change instructional models, widen standardization of lessons, increase testing/data-tracking, and reconfigure how teacher performance is evaluated. This can result in stricter oversight, including frequent data reviews, mandated turnaround plans, and tighter monitoring of low-performing campuses. TEA will likely zero in on the campuses that triggered the intervention (the F-rated or chronically failing schools) with extra support, oversight, or restructuring.</p><h2>What may not change</h2><p>It is unlikely your employment will be immediately impacted if TEA takes over. If you have an employment contract, it remains valid. And regardless of your position, if you have strong performance and are aligned with institutional goals, you have a better chance of navigating the transition well. Day-to-day classroom instruction may or may not change, but how instruction is monitored or supported may change. </p><h2>How you can prepare and respond</h2><p>Changes can be stressful, so keep up with announcements from district leadership and TEA about timelines, structural changes, and expectations. If there is a new leadership team, new evaluation frameworks, or turnaround plans, ask for clarity: what’s expected of you, what supports are in place, and what metrics will matter. And take the opportunity to build relationships with new leadership by asking constructive questions, offering ideas (when appropriate), and seeking professional development to align with the change agenda.</p><p>Be flexible and willing to adapt to changes: new curricula, new data tools, and new supports or mandates. The more you adapt and engage proactively, the more stable your role will be. And since TEA’s objective is improving student outcomes, if you keep student learning at the center of your work, you’re likely to be aligned with the district’s goals. </p><h2>What this means for school culture and your role</h2><p>When a district is under TEA intervention, the culture often shifts toward more centralized control, tighter accountability, and increased urgency around improvement. That means your role might feel different: There may be more direct oversight, more data collection, more frequent feedback/observation, and possibly less local autonomy than before. Understanding and accepting the increased scrutiny can help you manage expectations and stay focused on teaching, supporting students and building crucial relationships.</p><h2>Closing thoughts</h2><p>A state takeover is a major shift in a district’s governance and oversight, but it is not a reason to panic. For employees, the key is awareness, adaptability, and maintaining your focus on student success. 									<p>In a move that has sparked concern across Texas&#8217;s educational landscape, the Texas Legislature passed SB 412 May 19, 2025. The law took effect on Sept. 1, 2025, and amends a portion of the Texas Penal Code (specifically § 43.24) making it a criminal offense to sell, distribute, or display harmful material to a minor.</p><p>The amendments remove a longstanding affirmative defense for an educator who had a &#8220;scientific, educational, governmental, or other similar justification&#8221; for providing the materials. The affirmative defense now applies only to judicial and law enforcement officers discharging their official duties.</p><p>The definition of harmful materials remains unchanged. It is still defined as: “material whose dominant theme taken as a whole:</p><p>(A)  appeals to the prurient interest of a minor, in sex, nudity, or excretion;</p><p>(B)  is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable for minors; and</p><p>(C)  is utterly without redeeming social value for minors.”</p><p>Previously, if a school librarian or teacher was accused of providing &#8220;harmful&#8221; content to a student, they could argue it was for a legitimate academic purpose. That protection is now gone. The only individuals who retain this defense under the new law are those acting within their capacity for a judicial or law enforcement purpose.</p><p>The full impact of SB 412 remains to be seen, but it certainly gives teachers or librarians less protection if a parent accuses them of assigning or displaying books with sexual themes. Likewise, health and sexual education teachers are more susceptible to parental complaints that materials they teach related to certain subjects (sex, excretion, etc.) are harmful materials.</p><p>While the law seemingly makes it easier to bring charges, it will be up to local prosecutorial discretion to decide which cases to pursue—and that may certainly vary depending on the prosecutor and community standards. From a legal standpoint, the definition of harmful materials is fairly narrow, requiring the dominant theme of the materials to meet all three prongs listed above. The law also has a substantial knowledge requirement: The accused must know the materials are harmful. The accused must also know the recipient is a minor if they are selling, distributing, or exhibiting the material, or, if they are displaying harmful material, they must have been reckless about whether a minor is present.</p><p>Nonetheless, SB 412 removes a legal protection Texas educators once held. As a result, educators must be more cautious when choosing resources and materials to display, circulate, or use with students.</p><p> </p><p><em>The legal information provided here is accurate as of the date of publication. 									<p>When Gov. Greg Abbott signed Senate Bill (SB) 8, passed by the 89th Legislature during its second special session, Texas joined a growing list of states regulating access to restrooms and locker rooms in public facilities based on biological sex.</p><p>The measure—also referred to as the Texas Women’s Privacy Act or colloquially as “the bathroom bill”—has wide implications for state and local publicly owned facilities, including public schools. As districts prepare to implement the law before its effective date on Dec. 4, 2025, school employees should understand what it requires, what it prohibits, and how to navigate its gray areas.</p><h2>What spaces does SB 8 regulate?</h2><p>SB 8 mandates that multiple-occupancy private spaces—such as restrooms, locker rooms, and changing areas—in government-controlled buildings be designated for use by individuals based on their sex assigned at birth rather than on gender identity.</p><p>In practical terms, this means that students, staff, and visitors in Texas public schools must use the restroom or locker room that corresponds to their biological sex as listed on their initially issued birth certificate or other government record.</p><p>Single-occupancy restrooms are exempt and may remain gender-neutral.</p><h2>Who must comply with SB 8?</h2><p>In addition to the educational entities listed below, the law applies to state agencies and “political subdivisions of the state,&#8221; meaning a governmental entity of this state, including a county, municipality, special purpose district, or authority.</p><p>The law applies to the following educational entities:</p><ul><li>All public school districts and open-enrollment charter school facilities, including educational and administrative buildings</li><li>Public colleges and universities</li></ul><p>Private schools are not directly covered by SB 8.</p><h2>What steps must school districts take to comply with SB 8?</h2><p>School districts and other entities covered by the law must take “every reasonable step” to enforce the law. Although “every reasonable step” is not defined in the bill, it may include measures such as:</p><ul><li>Posting clear signage on multi-user restrooms and locker rooms</li><li>Updating student and employee handbooks</li><li>Providing staff training on how to respond to reports or complaints</li></ul><p>Districts that fail to comply could face steep civil penalties:</p><ul><li>$25,000 for a first violation</li><li>$125,000 for additional violations</li></ul><p>In addition, SB 8 authorizes both the Texas attorney general and private citizens to bring lawsuits to compel compliance.</p><h2>What does SB 8 mean for individual educators?</h2><p>Individual teachers, coaches, and staff are not personally subject to fines under the law, but they are expected to follow their district policies. Failure to do so could result in disciplinary action from the district and, for certified educators, potential sanctions by the State Board for Educator Certification (SBEC).</p><p>SB 8 does not require public educators to police bathrooms or question students, but they should review their district’s policies for guidance.</p><p>Until your district issues guidance, the safest approach is to:</p><ul><li>Avoid confrontation with students over restroom use.</li><li>Refer any observations, disputes, or concerns to campus administration.</li><li>Respect student privacy and maintain professionalism at all times.</li></ul><h2>Are there any exceptions to SB 8?</h2><p>SB 8 permits opposite-sex access to restricted facilities in certain circumstances:</p><ul><li>When assisting a child under the age of 10</li><li>When providing medical aid, maintenance, or custodial services</li><li>When providing emergency or law enforcement assistance</li><li>When assisting a person with a disability</li></ul><p>These exceptions are designed to allow ordinary school operations to continue without violating the law.</p><h2>What should you do now as a public school employee?</h2><ol><li>Watch for new district policies before making any decisions about restroom access.</li><li>Follow official procedures for handling questions, complaints, or incidents.</li><li>Respect all students’ privacy.</li><li>Document concerns or incidents neutrally and forward them to administration.</li><li>Stay informed—lawsuits and federal guidance could change the legal landscape before or after SB 8 takes effect.</li></ol><h2>What’s the bottom line?</h2><p>Texas’s new bathroom law places the legal responsibility on districts—not individual educators—but it will affect everyone’s daily routine.
