									<p>This summer, as educators walk away from their classrooms and campuses for a long-awaited and much-needed break, school board members will walk toward the boardroom to make difficult financial decisions that can have long-term impacts on students, families, educators, and entire communities.</p><p>The topic of school finance looms year-round. On a large scale, we see it in the news and in our social media feeds. Almost always, the news is discouraging—reductions in force, school closures, and districts adopting deficit budgets, then asking educators to do more with less.</p><p>It is important to understand how districts have arrived at this place and what needs to happen to move forward, but that is not the purpose of this article. Our objective here is to address what educators, who often suffer the most in these situations, can expect to experience when their district has budget problems.</p><h2>Staffing Changes and Workload Increases</h2><p>Perhaps most obviously, teachers can expect larger classes and more preps, and all employees can experience a more substantial workload due to staffing cuts.</p><p>Often, districts will first eliminate at-will positions and terminate at-will employees as doing so can result in some immediate financial relief. Districts will also often nonrenew probationary contract employees as a first line of defense because doing so does not require the district to show cause for the nonrenewal.</p><p>Districts may make the difficult choice to close campuses entirely or reduce or eliminate entire programs—such as athletics, fine arts, career and technical education, and other noncore curriculum programs. Affected contractual employees may be nonrenewed because of a program change or reassigned if there are placements on other campuses.</p><p>Being reassigned without regard to placement preferences is not ideal, but it’s often the only way to retain employment in the district under these circumstances.</p><h2>Contract Awareness and Assignment Flexibility</h2><p>It is always a good idea to know what kind of contract you have been issued by the district. Is it a term contract or probationary? What is the professional capacity noted?</p><p>Usually, those in nontraditional teaching roles, such as content specialists, dyslexia teachers, or instructional coaches, may be reassigned to classroom teaching positions. Districts may also direct teachers to obtain additional certifications, even if not required by the state.</p><p>Districts value flexibility in assignments, especially during a budget deficit. Knowing your contractual rights, as well as understanding the district’s authority under the contract, can help when changes are implemented quickly.</p><h2>Compensation and Resource Challenges</h2><p>Educators, particularly teachers, may take a financial hit with the reduction or removal of stipends. Because most stipends are locally created and funded, teachers may lose supplemental duty stipends, such as department chair, club sponsor, or tutoring, to name a few, often with an expectation that they continue the supplemental duty without pay.</p><p>Stipends tied to certain teaching assignments may also be eliminated. While districts often implement local raises annually, they are not required to do so. Districts cannot reduce a contractual employee’s pay without appropriate notice, but they are not required to raise pay between school years. Hiring freezes followed by pay freezes are common during a budget crisis.</p><p>On a micro level, educators experience daily supply, technology, and facilities issues that are often felt more acutely during a deficit. Campus budgets may be cut to a bare minimum, leaving technology, equipment, and facilities needs unmet.</p><p>Educators should not have to rely on their own resiliency in these situations, but often they do, all while getting the job done and making it look easy.</p><h2>Communication Matters</h2><p>Ideally, districts would plan well in advance for any major changes and communicate clearly with affected staff so educators can make informed decisions. Straightforward communication and timely information by the district can help reduce much of the stress that often comes with change.   </p><p>The ATPE Member Legal Services Department can provide advice to eligible members.</p>								</div>

									<h4>Think a change will do you good? </h4><p>Whether you’re seeking a new campus culture or administrative approach, a different grade level assignment, the opportunity to work in a specialized program, or just a shorter commute, a transfer might be on your mind. Whatever your reasons for seeking a transfer, it is important to recognize that transferring to a different assignment or campus can be more challenging than you would expect.</p><p>Many districts and charter schools do not allow mid-year transfers, so transferring between school years is often the only option. Knowing your district or charter school’s transfer process can help you approach a transfer request with confidence, ease, and realistic expectations.</p><h4>Local policies shape the transfer process</h4><p>State law does not address staff transfers in public schools, so districts and charter schools have local policies, sometimes unwritten, that dictate the process. If you are considering requesting a transfer, now is the time to prepare.</p><p>First, familiarize yourself with your district’s or charter school’s transfer procedure. Sometimes this is outlined in the employee handbook or board policy, but often it is not formally documented. Your district’s or charter school’s human resources office, principals, and supervisors should be familiar with the transfer process.</p><p>Districts and charter schools often open the transfer window early in the spring semester, so start keeping an eye out for those communications. The transfer window sometimes closes at a point near the end of the school year, but in other instances the window will only be open for a very short period of time, allowing only a few days or weeks to get on the list.</p><h4>Eligibility and approval requirements matter</h4><p>In addition to noting the applicable deadlines, you will need to identify the eligibility requirements for transferring. These can include but are not limited to the type of contract held (term vs. probationary), total years of experience, years of service in the district or charter school or on a particular campus, certification area, minimum appraisal scores, and acceptable student data.</p><p>Often, districts and charter schools will preclude staff from being able to request a transfer if they have appraisal scores lower than proficient or have received a reprimand or been placed on a professional growth plan. If you do meet all of the eligibility criteria, gather documentation in support of your qualifications, and be ready when the transfer window opens. Reach out to your professional contacts that may have information about potentially open positions, polish up your resume, and sharpen your interview skills, as the transfer process often requires interviewing with the hiring administrators.  </p><p>Perhaps most importantly, find out if your district or charter school requires that your current principal or supervisor approve employee transfers. This is a common requirement, and it will stop a transfer in its tracks if a principal or supervisor does not give it their blessing. If the current principal or supervisor’s approval is not required, then it is probably safe to celebrate once an offer is made, keeping in mind that districts and charter schools have authority to reassign employees at any time.</p>								</div>

									<p>Spring semester is upon us, marking the busiest of times for educators. While the countdown to spring break is officially on, so is the season of state testing, contract renewals, Teacher Incentive Allotment designations, and evaluations. </p>
<p>Formal observations and annual evaluations can be a source of great anxiety for educators, and understandably so. </p>
<p>Teachers are assessed on the skills they practice day in and day out, but only for a short window of time, and sometimes only once or twice per year. In some cases, an appraiser may not be personally familiar with you, or they may not have any experience in your content area. And sometimes Murphy’s law strikes. Anything that can go wrong will go wrong, no matter how experienced you are or how diligently you have prepared.</p>
<p>So much can be at stake in an evaluation. Results may affect contract renewal and eligibility for the Teacher Incentive Allotment. But what if your appraiser evaluates you unfairly? How do you navigate a situation where you are not in agreement with your observation report?</p>
<h2>Know your district or charter school appraisal system</h2>
<p>The first step in ensuring the most positive teacher observation process possible is familiarizing yourself with your district or charter school’s appraisal system. Second, understand that you must act quickly upon receiving an observation report or evaluation that you believe is unfair or inaccurate. </p>
<p>School districts and charter schools may choose which appraisal system to implement. They may adopt the state’s appraisal system, the Texas Teacher Evaluation and Support System (T-TESS), or a locally developed appraisal system.</p>
<p>T-TESS requires that new teachers, as well as teachers who have never been evaluated under T-TESS, receive training on the process at the beginning of the school year. All teachers should maintain any updated appraisal information distributed by their district or charter school for future reference. School boards must approve a list of certified appraisers and adopt an appraisal calendar each school year. Only persons on the certified appraiser list can conduct evaluations, and the appraisal calendar outlines when observations can occur and the timeline for completing the appraisal process.</p>
<h2>Act quickly after receiving an observation report</h2>
<p>Once a teacher receives an observation report, the clock starts ticking. The timeline to exercise your rights is short and is dictated by T-TESS policy or by your district or charter school’s local appraisal system policy. Under T-TESS, teachers have 10 working days to submit a rebuttal to an observation report and/or to request a second appraisal. </p>
<p>Submitting a rebuttal is often wise when an observation report is unfair or inaccurate or lacks appropriate context. Requesting a second appraisal might sound like an attractive option when an appraiser has been unfair, but it can also be a gamble. A second appraisal is usually conducted by an administrator chosen by the superintendent or human resources administrator and is often someone from another campus or an upper-level administrator. The results of a second appraisal do not always replace the first. The scores are often averaged or calculated in a manner that gives the original appraisal greater weight.</p>
<p>These decisions are made locally, and it is important to be aware of your district’s or charter school’s process before committing to a second appraisal.</p>
<h2>Understand timelines associated with the grievance process</h2>
<p>The only formal way to dispute an unfair evaluation is through your district’s or charter school’s grievance process. Filing a grievance does not guarantee that your appraiser will change your evaluation; it only guarantees the district will hear your concerns and consider your requested remedies.</p>
<p>Even if you plan to pursue a grievance, it is important to submit a timely rebuttal. If the grievance is unsuccessful, you will still have your rebuttal and any supporting evidence on file. Grievance timelines are decided locally and can vary. Most timelines are very short, especially in charter schools. Although many districts and charter schools generally have a 10 to 15 working day grievance deadline, some charter schools impose deadlines as short as five or seven calendar days. Keep these timelines in mind as you consider your options.</p>
<h2>Other considerations and available support</h2>
<p>Before pursuing the more drastic options of requesting a second appraisal or filing a grievance, consider meeting with your appraiser to discuss your concerns. While this can be an unnerving proposition, appraisers should be open to hearing your concerns and reviewing any evidence you provide to refute negative scores or comments. Situations involving unfair evaluations are often resolved through communication and compromise, so consider this option as seriously as the others and make sure you are working within the allowable timelines.</p>
<p>If you are attempting to qualify for the Teacher Incentive Allotment, this adds another layer of significance to your appraisal. Teachers in this situation should review their district’s or charter school’s local Teacher Incentive Allotment designation plan and consult the administration with any questions. Participating districts and charter schools are required to designate an administrator to serve as a Teacher Incentive Allotment coordinator, and this individual should serve as a knowledgeable resource on the designation process.</p>
<p><em>All</em> district and charter school employees are subject to performance appraisal. However, except for teachers and principals, there is no state-mandated appraisal process. Non-teacher and non-principal faculty and staff are evaluated using locally developed processes. These employees should receive training on their respective appraisal processes, and they can find information on their rights in board policy or in the employee handbook or can obtain it from their administrators and supervisors. Generally, all employees have the right to respond to and file a grievance regarding an unfair or inaccurate evaluation, subject to the applicable response and grievance timelines.</p>
<p>The ATPE Member Legal Services Department can provide advice to eligible members about how to navigate an unfair evaluation.</p>								</div>

									<p>Senate Bill (SB) 571 passed by the 89th Legislature changes the mandatory reporting requirements for educators (and other “professionals” as defined in the bill) who have reasonable cause to believe a child has been abused and neglected. The bill amends Texas Family Code Sections 261.001 and 261.101. Although there are some minor changes discussed below, <strong>the primary change is the time limit to report has been cut in half—from 48 hours to 24 hours.</strong>  </p><h2>Who Is Subject to the 24-Hour Rule?</h2><p>The 24-hour rule applies to “professionals,” defined as “an individual who is licensed or certified by the state or who is an employee of a facility licensed, certified, or operated by the state and who, in the normal course of official duties or duties for which a license or certification is required, has direct contact with children.” This includes all employees of a school district or charter school, as well as juvenile detention and correctional officers.</p><p>The 24-hour rule does not apply to those not defined above as professionals. However, everyone in Texas is considered a mandatory reporter of abuse and neglect. The difference is that criminal penalties apply to professionals who do not report within 24 hours. Other members of the public have an obligation to report abuse or neglect “immediately.” So, while it is best practice for everyone to report quickly, the criminal penalty would not apply to those not defined as “professionals.”</p><h2>When to Make a Report</h2><p>An obligation to report is created when there is “reasonable cause to believe that a child&#8217;s physical or mental health or welfare has been adversely affected by abuse or neglect.” Section 261.001 of the Texas Family Code contains specific definitions of abuse and neglect, which can be found <a href="https://atpe.org/Legal-Benefits/Common-Legal-Questions/Reporting-Child-Abuse" target="_blank" rel="noopener" data-feathr-click-track="true" data-feathr-link-aids="5df34522dc3cdfabf6401f28">here</a>.</p><p>SB 571 expands the definition of abuse to include “sexual conduct harmful to a child’s mental, emotional, or physical welfare, including conduct that constitutes an improper relationship between an educator and a student under Texas Penal Code § 21.12.”</p><p>The law requires a report when there is reason to suspect abuse might be occurring, therefore an individual must make a report even if they have no way of confirming their suspicions. Trained professionals at the Child Abuse Hotline at (800) 252-5400 can provide more information about whether a behavior is indicative of abuse or neglect to anyone who observes behavior in a child that gives you cause for concern.</p><h2>Where to Submit a Report</h2><p>Considering that the majority of abuse and neglect situations a school district employee encounters will “involve a person responsible for the care, custody, or welfare of the child,” it will usually be best (and safest) to report directly to the Texas Department of Family and Protective Services (“TDFPS&#8221; but commonly referred to as “CPS”). Reports can be made to the TDFPS by calling the Child Abuse Hotline at (800) 252-5400, a service of the TDFPS. The report can also be made electronically on the TDFPS at <a href="https://www.dfps.texas.gov/Contact_Us/report_abuse.asp" target="_blank" rel="noopener" data-feathr-click-track="true" data-feathr-link-aids="5df34522dc3cdfabf6401f28"><em>www.dfps.state.tx.us/contact_us/report_abuse.asp</em></a>.</p><p>Other abuse and neglect reports can be made to:</p><ul><li>A law enforcement agency, defined as the Texas Department of Public Safety, the police department of a municipality, the sheriff’s office of a county, or a constable’s office of a county. The definition does not include a police department of an educational entity.</li><li>The state agency that operates, licenses, certifies, or registers the facility in which the alleged abuse or neglect occurred.</li></ul><p>The reporting duty cannot be delegated to another employee. While it is normally advisable to notify an administrator or counselor of child abuse or neglect, doing so will not satisfy the legal requirement to report.</p><h2>Consequences of Not Reporting</h2><p>The Texas Family Code considers every Texan a mandatory reporter who is expected to report suspected abuse and neglect “immediately.” However, for those defined as “professionals,” failure to report within 24 hours can result in criminal prosecution or civil liability.</p><p>Knowingly failing to report is a class A misdemeanor punishable by up to one year in jail, a fine of up to $4,000, or both jail time and a fine.</p><p>The penalty is enhanced to a state jail felony if there was an intent to conceal the abuse or neglect or if the child has intellectual disabilities, resides in a state supported living center, and suffers serious bodily injury as a result of the abuse or neglect.</p><p>Failure to timely report could also subject an individual to considerable monetary liability in a civil rights lawsuit and result in sanctions to their professional certificate or inclusion on the state’s Do Not Hire Registry.</p><h2>Additional Resources</h2><p>Additional information and resources, including a helpful <a href="https://www.dfps.texas.gov/contact_us/report_abuse_faqs.asp" target="_blank" rel="noopener" data-feathr-click-track="true" data-feathr-link-aids="5df34522dc3cdfabf6401f28">FAQ</a>, can be found on the TDFPS <a href="https://www.dfps.texas.gov/default.asp" target="_blank" rel="noopener" data-feathr-click-track="true" data-feathr-link-aids="5df34522dc3cdfabf6401f28">website</a>.
